In a dramatic turn of events that has sent shockwaves through Nigeria’s political landscape, no fewer than 13 states have announced dates for their local government elections following a landmark Supreme Court judgement that declared the federal allocation to councils administered by caretaker committees unconstitutional. This pivotal ruling, which prohibits state governors from holding funds allocated for local government councils, has sparked a flurry of electoral activity across the nation, with states rushing to comply with the new legal mandate.

No fewer than 13 states have announced dates for their local government elections following a landmark Supreme Court judgement that declared the federal allocation to councils administered by caretaker committees unconstitutional. Wednesday, July 17, 2024.

The Supreme Court Verdict: A Game Changer for Local Governance

The Supreme Court’s decision, delivered by Justice Emmanuel Agim, unequivocally stated that the 774 local government councils in Nigeria should manage their funds independently. This ruling came in response to suit SC/CV/343/2024 filed by the Attorney-General of the Federation and Minister of Justice, Lateef Fagbemi (SAN), against the 36 state governors. The judgement emphasized the constitutional division of government into three tiers: federal, state, and local, and declared the practice of appointing caretaker committees by state governors as unconstitutional.

The court’s verdict has been hailed as a monumental step towards ensuring the autonomy of local governments, a move that promises to transform the governance and administrative landscape at the grassroots level. By putting an end to the long-standing practice of state governments hijacking local government funds, the Supreme Court has reinforced the principle of democratic governance and accountability.

States Gear Up for Elections: A New Dawn for Local Governance

In response to this judgement, states across Nigeria have swiftly moved to schedule local government elections. Among the first to act was Bauchi State, which fixed its local government poll for August 19, followed by Kogi State, which set October 19 as its election date. Other states, including Jigawa, Imo, Anambra, Abia, Katsina, Kebbi, and Benue, have also set dates for their elections, signaling a nationwide shift towards compliance with the Supreme Court’s ruling.

The Kaduna State Independent Electoral Commission (KAD-SIECOM) announced October 19, 2024, as the date for its council elections. At a meeting with political parties and stakeholders, KAD-SIECOM Chairperson Hajara Mohammed emphasized the importance of adhering to the provisions of the KAD-SIECOM Law 2024 and ensuring a transparent and credible electoral process.

In Kogi State, the Independent Electoral Commission announced a comprehensive timetable and schedule of activities to ensure a fair and transparent election process. Chairman Mamman Eri assured stakeholders of the commission’s commitment to inclusivity, transparency, and adherence to electoral laws.

Similarly, Bauchi State Independent Electoral Commission has set August 19 for its local government elections. Chairman Alhaji Ahmad Makama assured citizens of a credible and transparent election, urging them to participate actively in the electoral process.

The Political Implications: A Shift in Power Dynamics

The Supreme Court’s ruling and the subsequent rush to hold local government elections have significant political implications. For years, state governors have wielded considerable influence over local government councils by appointing caretaker committees, a practice that allowed them to control local government funds and administration. This power dynamic is now being challenged, potentially reducing the influence of state governors and increasing the autonomy and accountability of local councils.

This shift is likely to impact the political landscape at both the state and local levels. With local governments now empowered to manage their funds independently, there is a potential for increased development and more effective delivery of public services at the grassroots level. This could lead to greater political engagement and participation among citizens, as they see more direct benefits from local governance.

Challenges and Controversies: Navigating the New Terrain

While the Supreme Court’s ruling is a significant step towards ensuring local government autonomy, it is not without challenges and controversies. The implementation of this judgement requires a complete overhaul of the existing governance structures and practices, which may face resistance from entrenched political interests.

In Ondo State, for instance, the preparation for the council election has been put on hold due to non-compliance with election guidelines by political parties. The Chairman of the Ondo State Independent Electoral Commission, Dr. Joseph Aremo, expressed regret over the postponement, emphasizing the need for political parties to adhere to electoral guidelines.

Furthermore, the decision has sparked debates about the capacity and readiness of local governments to manage their funds independently. Critics argue that many local councils lack the necessary administrative and financial expertise to handle their budgets effectively, potentially leading to mismanagement and corruption.

The Path Forward: Building a Stronger Local Government System

Despite these challenges, the Supreme Court’s ruling represents a significant opportunity to strengthen local governance in Nigeria. By ensuring that local governments receive and manage their funds directly, the judgement has the potential to promote greater accountability, transparency, and efficiency in the delivery of public services.

To fully realize this potential, there is a need for comprehensive capacity-building initiatives aimed at enhancing the administrative and financial management skills of local government officials. This includes training on budget planning and execution, financial reporting, and governance best practices.

Moreover, there is a need for robust oversight mechanisms to ensure that local governments adhere to principles of accountability and transparency. This includes regular audits, performance evaluations, and the establishment of citizen feedback mechanisms to monitor the delivery of public services.

Conclusion: A New Era for Local Governance in Nigeria

The Supreme Court’s landmark ruling on local government autonomy marks the beginning of a new era for local governance in Nigeria. As states scramble to hold local government elections, there is a renewed sense of hope and optimism for a more democratic and accountable governance system at the grassroots level.

While challenges remain, the path forward lies in building the capacity of local governments and establishing robust oversight mechanisms to ensure effective and transparent management of public funds. By doing so, Nigeria can create a stronger, more resilient local government system that truly serves the needs and aspirations of its citizens.

This momentous shift in the political landscape underscores the importance of judicial independence and the role of the judiciary in upholding democratic principles and ensuring the rule of law. As Nigeria moves forward, the Supreme Court’s ruling will be remembered as a pivotal moment in the country’s democratic journey, paving the way for a more equitable and just governance system.
